You do not need to build up any period of qualifying service to make a claim based on discrimination.  However, a time limit of 3 months applies to discrimination claims in the Employment Tribunal.

 


Discrimination is unfavourable treatment based on race, sex, disability, age, sexual orientation, religion or belief.

 

Direct discrimination” is where you have been treated less favourably than somebody else on one of these grounds.

 

 “Indirect discrimination” is more complex but it arises where, a condition is imposed that applies to all employees but the effect of the condition is unfair because you and other people in your minority sub-group find it more difficult to comply with.

Discrimination claims can sometimes be brought by job applicants as well as existing employees.

 

Sex discrimination covers a wide range of situations including:

 

q     Equal pay claims

q     Pregnancy-related dismissals

q      Flexible working time requests

q     Time off to care for dependants

 

To bring a Disability Discrimination claim it is not necessary for you to be registered as a disabled person.  Instead, you need to demonstrate that you have a disability that has lasted or is likely to last over twelve months and has a substantial effect on your day to day activities. 

Discrimination Claims based on Sexual Orientation and Religious belief are fairly new to UK Law but they operate on familiar lines to the existing laws on race and sex discrimination
